As required by Chapter 2 of the Information Society Services and Electronic Commerce Act (Law 34/2002), this is notice that this website is the property of LOIS COUNSEL, S.L. (LOIS) (also, the “Provider”), whose registered office is at Via Augusta 29, 6º, 08006, Barcelona and whose UTR is: B-67059253 and whose email address is: info@loiscounsel.com.

LOIS as the owner of this website and in accordance with the law now in force in relation to the protection of personal database, Regulation (EU) 2016/679 of 27 April 2016 (“GDPR”) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, the Spanish Data Protection Act 1999 (Organic Law 15/1999 of 13 December), and by the Information Society Services and Electronic Commerce Act (Law 34/2002 of 11 July), has adopted all the organisational and technical security measures set out in Royal Decree 1720/2007 of 21 December, the implementing regulations for the Data Protection Act 2002, to ensure and protect the confidentiality, integrity and availability of the personal data collected.

As required by the Data Protection Act, LOIS gives you notice that the personal data that you have voluntarily provided to us will be incorporated into our information systems in order to perform the required commercial and administrative processes in relation to users of the website. The operations by which personal data is intended to be processed are the following: to respond to enquiries and/or to provide the information requested by users; to provide the services and/or products contracted or subscribed to by users; to send advertising, promotions and digital content associated with the products, services and actions of the buisness.

The Provider has marked with an asterisk (*) the boxes in the contact forms whose completion by users and consequent provision of personal data is mandatory. By giving and entering their personal data, the user gives express consent to LOIS to process the personal data provided for the stated purposes.

Not providing the personal data requested or not accepting this Privacy and data protection policy will make it impossible to subscribe or register for or to receive information about the Provider’s products and services.

As required by the law concerning the protection of personal data, the Provider complies with all provisions of the GDPR and the Data Protection Act as to the processing of personal data in respect of which it is the data controller.

The DATA CONTROLLER warrants that it has adopted the organisational and technical measures required to implement the security measures required by GDPR and the Data Protection Act to protect the rights and freedoms of data subjects.

You also have the right to make a complaint to the supervisory authority if you believe that your data protection rights have been breached (agpd.es).

CONFIDENTIALITY AND DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

The personal data that you provide to use will be processed confidentially. The Provider has implemented all the technical and organisational measures and adopted all the levels of protection required to ensure the security of the processing of personal data and to avoid their alteration, loss, theft, and unauthorised processing or access according to the state of the technology and the nature of the personal data stored. Those measures will also ensure that the processing and filing, programs, systems and devices, places and facilities will meet provide the integrity and security required by law.

LOIS will not transfer personal data to third parties, except when required to do so by law. However, notice will be given of any proposed disclosure to a third party in order to seek the data subject’s consent to such disclosure. The data controller for the database and any organisation involved at any stage of data processing and/or the organisations to which any personal data has been disclose, which in all cases will be with the prior written consent of the data subject, will be required to maintain confidentiality and to adopt the levels of protection and the organisational and technical measures available to them to ensure the security of personal data and to the extent possible to avoid unauthorised access, improper modification, theft and/or loss of any personal data so as to achieve the same level of security as the filing system of the Provider, in function of the nature and sensitivity of the personal data provided by users of this website.

ACCEPTANCE AND CONSENT

Each user is solely responsible for the truthfulness and accuracy of the personal data that they provide to LOIS and they excuse the Provider from all liability in that regard. Each user warrants and accepts liability for the accuracy, currency and truthfulness of any personal data provided in all circumstances and undertakes to keep such data up to date. Each user agrees to provide complete, correct information in their registration or subscription form.

SUBSCRIPTION TO THE LOIS COMMUNITY, NEWSLETTER OR BLOG

This is notice that when a user subscribes to any of the channels or content in the heading to this section, any personal data provided will be processed to manage their registration and subscription by sending or accessing content, and that such data will be retained for so long as there is a mutual interest that requires such processing. When it is no longer to retain personal data for that purpose, the personal data will be deleted with sufficient security measures to ensure their pseudonymisation or complete destruction. Personal data will not be disclosed to third parties except as required by law.

LOIS reserves the right to amend this policy in response to changes in law.

COMMERCIAL EMAILS

In accordance with the Information Society Services Act, LOIS does not send SPAM and as such does not send commercial emails that have not been solicited or authorised by the recipient. Consequently, each form on the Website asks the user to give their express consent to receipt of our content separately from any specific commercial information requested.
